The Carry Collective – Carrier Access
1. Welcome
Welcome to The Carry Collective. This Carrier Access Subscription Agreement (“Agreement”) explains how our Carrier Access service works, what you can expect from us, and what we need from you in return. We’ve written this in clear, human language (not scary legal jargon), but it’s still a legally binding agreement.
By placing an order or activating a Carrier Access subscription, you confirm that you have read, understood, and agreed to the terms below.
2. What is Carrier Access?
Carrier Access is a subscription-based hire service that gives you access to a premium baby carrier from our collection.
Here’s the simple version:
- You order a carrier
- You pay weekly, with a minimum commitment of 4 weeks
- You keep the carrier for as long as you want
- Your subscription renews weekly
- When you return the carrier and it passes inspection, payments stop
3. Minimum Term & Ongoing Subscription
- All Carrier Access subscriptions have a minimum term of four (4) weeks.
- Payments are charged weekly in advance.
- After the initial 4-week period, your subscription continues on a rolling weekly basis until the carrier is returned and accepted by us.
- There is no maximum hire period — you’re welcome to keep the carrier as long as you need it.
4. Payments & Billing
- Payments are processed automatically using the payment method provided at checkout.
- Weekly charges will continue until:
- the carrier is returned, and
- the carrier passes inspection.
- You remain responsible for all charges until both conditions are met.
Failed Payments
If a payment fails:
- We will automatically retry the payment.
- If payment remains unsuccessful after 7 days, an invoice reminder will be sent.
- After 14 days, a final reminder will be issued.
- If payment is still outstanding, a formal letter of demand will be sent.
- Continued non-payment may result in:
- the full replacement value of the carrier becoming immediately payable, and
- referral to a debt recovery service.
We genuinely prefer friendly resolution and communication — but we do need to protect our business and assets.
5. Shipping & Returns
- Outbound shipping is paid by the customer at checkout.
- All orders include a return shipping label, provided with your order.
- There is no fixed return timeframe. You may return the carrier whenever you’re ready using the return label supplied.
Returns
- Simply use the return label provided when you decide to return the carrier.
- Weekly subscription charges continue until the carrier is physically received by us.
6. Condition, Care & Use of Carriers
General Care
You agree to:
- Use the carrier with reasonable care
- Follow manufacturer guidelines
- Keep the carrier clean and dry
Washing Policy
Carriers must not be washed by customers.
This includes:
- machine washing
- hand washing
- soaking
- stain treatments
Improper washing can permanently damage carrier fibres and structure. If cleaning is required, please contact us first.
Damage & Excessive Wear
- All carriers are inspected on return.
- Normal wear from appropriate use is expected.
- You may be charged for:
- stains
- odours
- damage
- unauthorised washing
- missing components
- Significant damage may result in the full replacement cost being charged.
7. If a Carrier Is Not Returned
If a carrier is not returned:
- Weekly subscription charges will continue indefinitely
The carrier remains the property of The Carry Collective at all times.
8. Loss or Theft
- You are responsible for the carrier while it is in your possession.
- In the event of loss or theft, you must notify us immediately.
- You may be charged the full replacement value of the carrier.
9. Use at Your Own Risk – Important Disclaimer
The Carry Collective does not provide babywearing education, fitting services, or safety instruction.
By using our service, you acknowledge that:
- It is your responsibility to learn how to use the carrier correctly
- You must independently seek guidance from:
- the manufacturer
- qualified babywearing consultants
- trusted instructional resources
We are not responsible for:
- incorrect use
- improper fit
- injury to you or your child resulting from misuse
10. Safety & Suitability
You confirm that:
- You have checked that the carrier is suitable for your baby’s age, weight, and developmental stage
- You will follow all manufacturer safety instructions
- You will discontinue use if the carrier appears unsafe or damaged
11. Limitation of Liability
To the fullest extent permitted by law:
- The Carry Collective is not liable for indirect or consequential loss
- Our liability is limited to the amount paid by you during your subscription period
Nothing in this Agreement limits rights under Australian Consumer Law.
12. Termination
We reserve the right to suspend or terminate a subscription if:
- payments remain outstanding
- the carrier is misused or mistreated
- this Agreement is breached
13. Changes to This Agreement
We may update this Agreement from time to time. The version in effect at the time of your order applies to your subscription.
14. Governing Law
This Agreement is governed by the laws of Victoria, Australia.
